Residential Eviction

For tenant eviction a landlord would generally serve one of two notices under the Housing Act 1988. A Section 8 Notice is a 14-day notice seeking possession due to rent arrears, nuisance or breach of tenancy. A Section 21 Notice is a two month notice to terminate a tenancy agreement and seek possession. Legal 4 Landlords often serve both simultaneously

  • Court Proceedings & Hearing To evict a problem tenant, Legal 4 Landlords Eviction Team issue court proceedings against your tenant, arrange the court date, arrange all your legal papers and go before the judge to obtain a possession order for regaining the property. This fee also includes a Court Issue Fee.

  • Bailiff instruction Very few nuisance tenants will remain in a property after a Possession Order has been granted. If the tenant does remain then our Eviction Team will arrange for the court bailiffs to remove your tenant, and you get your property back.

    Fixed Fees Explained

    Our fees are fixed due to two factors, firstly the amount of evictions we do therefore we can justify a cost effective service. Secondly with regards to Eviction Step Two, most cases are not defended by the tenant, thus reducing the amount of time utilised in court by our solicitors.

    However, there are some cases where by the judge may adjourn the court hearing or the tenant puts in a mitigating defence. As I am sure you can appreciate, if this does happen, which is rare we will continue to move forward with this case on your behalf at an agreed fee.

    This fee will be much lower for you rather than opting to use your own solicitor, on the other hand if you would like to continue with your own solicitor we would hand over all case information to you at no charge.

    Hopefully this will not happen, but we , as Legal 4 Landlords cannot guarantee it.

    Eviction Step One: What happens next ?

    STEP 1

    Complete the simple online form and payment

    STEP 2

    An experienced member of our Eviction Team will contact you within two hours

    STEP 3

    We will serve the relevant notice(s) on your tenant within 48 hrs

    STEP 4

    The tenant will move out or settle their debt If not then move to Eviction Step Two.

    Eviction Step Two: What happens next ?

    STEP 1

    Complete the simple online form with payment and one of our eviction experts will contact you within 2 hours

    STEP 2

    The eviction team will process your paperwork and apply to court for a hearing date.

    We can get a court date within 72hrs.

    STEP 3

    The eviction team will contact you to discuss the hearing date and confirm the solicitor is appointed and booked.

    STEP 4

    Upon a successful hearing you will be typically granted a 14 day possession notice, if the tenant doesn't leave move to step 3.

    Eviction Step Three: What happens next ?

    One of our eviction experts will contact you within 2 hours

    The eviction team will process your paperwork and apply for a bailiff attendance date.

    STEP 4

    The bailiff will meet you at the property to remove the tenants.

    How many weeks' arrears does my tenant have to be in?

    None, there can be many different reasons on why you would want to evict your tenant(s), and these reasons affect which notices you can give the tenant before starting court proceedings. Our trained and qualified advisors will tell you the fastest way to evict your problem tenant.

    I haven't registered my deposit, can I still evict my tenant?

    Yes, but we would advise that you register the deposit immediately. This can be done on our website, search 'deposits' and register this online for a certificate number then contact the team today to begin the eviction process.

    I have lost my tenancy agreement and my tenant is in arrears, can I start proceedings?

    Yes, we can evict the tenant on the basis that rent payments have been made. Contact us today to discuss this further as we will require further information to ensure we can help.

    Do I get my own solicitor?

    Yes, we will appoint one to represent you in court should this action be required.

    How long does the eviction process take?

    Most tenants leave after Eviction Step 1, those that don't will have to be evicted through the courts. This can take between 8 weeks and 12 weeks depending on what notice has been served. In some cases the timescale will be longer but our team will tell you this before any payment is made.

    If my property is in London, will the process take longer ?

    If Legal 4 Landlords' eviction team are dealing with any London courts, hearings take a few weeks longer than any other county court.
